Port Aransas Boat Rentals LLC, d/b/a Port A Boat Rentals (“we,” “us,” or “our”), respects your privacy. This policy explains what information we collect, how we use it, who we share it with, and your choices. It applies to our website and the reservation process. Additional privacy disclosures specific to your rental — including GPS monitoring, media consent, and waiver documentation — are contained in the Liability Waiver and Vessel Rental Agreement signed at the dock, which are incorporated by reference into this policy.

1. Who We Are

We are Port Aransas Boat Rentals LLC, a Texas limited liability company operating out of Island Moorings Yacht Club, Port Aransas, Texas. Our vessels are owned by Freedom Waves LLC, an affiliated entity under common ownership. Both entities may access operational, rental, and incident records as described in this policy.

2. Information We Collect

When you visit our website, make a reservation, or rent from us, we collect the following categories of information:

  • Identity and contact information — name, date of birth, phone number, email address, mailing address, emergency contact details
  • Government-issued identification — driver’s license, passport, or other government ID, and, where required by Texas law, your Boater Education Certificate or equivalent credential
  • Reservation and transaction data — rental dates, vessel selected, package type, add-on selections, and payment information processed securely through our third-party payment processor (we do not store full payment card numbers on our systems)
  • Geolocation and vessel operational data — real-time GPS location, speed, route, geofence interactions, and other operational data captured by Boatfix and onboard navigation systems during your rental
  • Photographs and video — time-stamped images of the vessel and equipment before and after your rental for inspection purposes, and, with consent provided through the Liability Waiver’s Media Release, images and video captured during your rental
  • Communications — messages you send us by email, text, phone, web form, or through our booking platform, and our responses
  • Website usage data — IP address, browser type, device identifiers, pages visited, referring URL, and cookie data
  • Inferred information — preferences, rental patterns, and similar information derived from the data above for service improvement and analytics

We collect additional information at the dock through your signed rental documents, including vessel condition attestations and any disclosures made in the Liability Waiver and Vessel Rental Agreement.

Under Texas law, geolocation data and certain other categories are treated as sensitive personal information. Your consent to collection of sensitive information is provided through your signed Vessel Rental Agreement and Liability Waiver.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Process and manage your reservation, communicate booking confirmations, pre-trip reminders, and post-rental follow-up
  • Verify your identity and eligibility, including compliance with Texas boating laws and our Operator Eligibility requirements
  • Manage payments, security deposits, and credit card authorization holds
  • Operate our vessels safely, including real-time monitoring of location, speed, and geofence compliance
  • Document vessel condition and add-on equipment before and after each rental for damage assessment and dispute resolution
  • Respond to incidents, damage claims, insurance matters, regulatory inquiries, and legal proceedings
  • Send marketing and promotional communications where you have opted in, and process opt-out requests
  • With your consent under the Media Release, use photographs and video for marketing, social media, promotional materials, partner co-marketing, derivative works, third-party licensing, and to train, develop, or improve artificial intelligence and machine learning systems
  • Maintain, secure, and improve our website, booking platform, and customer service
  • Comply with applicable Texas and federal law, including tax, recordkeeping, and reporting obligations

4. GPS & Vessel Monitoring

All rental vessels are equipped with Boatfix GPS tracking, speed monitoring, and geofence enforcement. By renting a vessel, you consent to real-time location and operational data collection throughout the rental period. This data is used to enforce safety boundaries, document compliance with the Vessel Rental Agreement, support incident investigation, and verify return.

GPS location data is classified as sensitive personal information under Texas law. Your affirmative consent to collection is provided through your signed Vessel Rental Agreement and Liability Waiver, where this data use is specifically disclosed. The Liability Waiver provides the complete disclosure regarding this monitoring.

5. Photos and Video

We document vessel condition before and after every rental using time-stamped photographs and video. These records are used for damage assessment, dispute resolution, and operational records.

With your consent — provided through the Media Release in your Liability Waiver — we may also use photographs, video, and audio captured during your rental for marketing, social media, promotional materials, partner co-marketing, derivative works, third-party licensing, and to train, develop, or improve artificial intelligence and machine learning systems. The Liability Waiver’s Media Release sets forth the complete terms of this use, including its perpetual and irrevocable nature.

You may decline photo and video capture for future rentals by notifying us before your rental at reservations@portaboatrentals.com. Media captured during prior rentals under the Liability Waiver’s Media Release is governed by that release and is not subject to retroactive revocation.

6. Who We Share Your Information With

We do not sell your personal information. We share it only with:

  • Freedom Waves LLC — our affiliated vessel-owning entity, for operational and insurance purposes
  • Service providers under contract — our booking platform, insurance and damage program administrator, GPS provider, payment processor, banking services , and similar vendors. Each is bound to use your data only to provide services on our behalf
  • Insurance brokers, carriers, and adjusters — including our marine insurance broker and carrier, and the damage program, in connection with policy administration, claims, and incident investigation
  • Lenders and financial counterparties — our lender of record in connection with vessel financing and operational reporting required by our financing arrangements
  • Tax authorities, accountants, and auditors — the Internal Revenue Service, Texas Comptroller, our accounting professionals, and similar parties, in connection with tax, recordkeeping, and audit obligations
  • Marina, harbor authority, U.S. Coast Guard, Texas Parks & Wildlife Department, and other regulatory bodies — when required by law, regulation, or safety
  • Legal counsel, insurers, and courts — in connection with an incident, claim, dispute, regulatory inquiry, or litigation
  • Successor entities — in the event of a merger, acquisition, asset sale, or similar business transaction, your information may transfer to the successor entity, subject to this policy

7. Data Retention

We retain your information for the periods required by Texas law, federal law, our insurance and tax obligations, and operational needs. Categories and standard retention periods include:

  • Rental records, signed waivers, identification copies, and payment data — four (4) years from the rental date
  • Geolocation, GPS, and vessel operational data (Boatfix) — two (2) years from the rental date
  • Photographs and video of vessel and equipment — two (2) years from the rental date
  • Insurance correspondence and claims documentation — seven (7) years from incident closure
  • Tax and financial records — seven (7) years from filing
  • Vessel maintenance records — vessel lifetime, plus four (4) years following sale or disposal of the vessel
  • Marketing materials, opt-in records, and consents — for the duration of your guest relationship plus four (4) years
  • Website analytics and usage data — per our analytics provider’s standard schedule, generally not more than 26 months
  • Cookies — per the duration set by each cookie (see Section 8)

If any of the data described above relates to an incident, claim, complaint, regulatory inquiry, or actual or threatened legal proceeding, we retain that data indefinitely until the matter is resolved and any applicable statute of limitations has expired, regardless of the standard retention periods above. This practice is governed by our internal Litigation Hold and Document Retention Protocol.

8. Cookies & Tracking Technologies

Our website uses cookies and similar technologies to support the booking process, analyze site usage, and improve your experience. We use the following categories of cookies:

  • Strictly necessary cookies — required for site functionality, including reservations and account access. These cannot be disabled without affecting site functionality.
  • Performance and analytics cookies — help us understand how visitors use our site so we can improve it.
  • Functional cookies — remember your preferences and settings.
  • Marketing and advertising cookies — used to deliver relevant advertising on our site and on third-party platforms.

We may use third-party services that place cookies on our site, including web analytics providers and social media platforms. You can control cookies through your browser settings, though disabling certain cookies may affect site functionality, including the reservation process. We do not respond to “Do Not Track” browser signals because no uniform standard exists.

9. Your Rights and Choices

Under Texas law (the Texas Data Privacy and Security Act) and other applicable laws, you may exercise the following rights with respect to your personal information:

  • Right to know and access — confirm whether we process your personal information and request a copy
  • Right to correct — request correction of inaccurate personal information
  • Right to delete — request deletion of your personal information, subject to our legal, insurance, and operational retention obligations
  • Right to portability — request a copy of your personal information in a portable format, where technically feasible
  • Right to opt out of marketing communications — unsubscribe from marketing emails using the link in any message or by contacting us directly
  • Right to opt out of targeted advertising, profiling, or sale of personal information — although we do not sell personal information
  • Right to appeal — if we decline a request, you may appeal that decision by contacting us at the address below, and we will respond within a reasonable time
  • Authorized agent — you may designate an authorized agent to submit a request on your behalf, subject to our verification of the agent’s authority

To submit a request, contact us at reservations@portaboatrentals.com or by mail at the address in Section 13. We may ask you to verify your identity before processing a request to protect against fraudulent submissions. We will acknowledge data requests within five (5) business days and resolve them within thirty (30) days. In limited circumstances, we may extend this period and will notify you of any extension and the reason for it.

10. California Residents

We do not sell personal information as that term is defined under the California Consumer Privacy Act (CCPA). California residents may contact us at reservations@portaboatrentals.com to request a summary of personal information collected and the purposes of its collection. California residents also have the rights described in Section 9, to the extent applicable under California law.

11. Children's Privacy

Our services are directed to adults aged twenty-five (25) and older who serve as Guest Operators, with their family members, friends, and guests aboard as passengers. We do not knowingly collect personal information directly from children under the age of thirteen (13) without verifiable parental consent. Parents or guardians providing information about minor passengers in connection with a rental, or signing the Liability Waiver on behalf of a minor, do so as the minor’s legal representative under our Liability Waiver. If you believe we have inadvertently collected personal information from a child under thirteen, please contact us and we will promptly investigate and take appropriate action.

12. Security

We use reasonable administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, disclosure, alteration, or destruction. In the event of a breach affecting your personal information, we will notify you as required by Texas Business and Commerce Code §521.053 and other applicable laws. No method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

13. SMS & Text Messaging

Port Aransas Boat Rentals LLC does not share mobile numbers, text messaging originator opt-in data, or consent with any third parties or affiliates for marketing or promotional purposes.

Mobile information may be shared only with subcontractors and service providers that support the delivery of SMS services, such as messaging platforms, telecommunications providers, or customer support vendors. This information is used solely to provide and operate the messaging service.

All other use case categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.

14. Changes to This Policy

We may update this policy from time to time. The revised policy will be posted on this page with an updated “Last Updated” date. Material changes will be communicated by a notice on our website or by direct email where appropriate. Your continued use of our services after the revised policy is posted constitutes acceptance of the updated policy.
